JUDGE AUDLIN: OFFICER SANCHEZ DID NOT HAVE PROBABLE CAUSE TO MAKE THE TRAFFIC STOP

You may have read or heard that I was convicted last week of driving under the influence(DUI). It is true that I was convicted.
We are disappointed,of course. Attorney Michael “Mick” Barnes— who represented me since my arrest last November— developed and presented a defense that argued I was not “impaired” (lawyertalk) when Police Officer Luis Sanchez pulled me over in the middle of my six-block commute from the Veterans of Foreign Wars (VFW) hall to my home. We now know that he recognized my car in the parking lot and that he was waiting outside for me to come out.
Our case also argued that, by arresting me, Sanchez was just trying to get even for a number of stories and commentaries that we had written and published about him over a three-year period. As you read this longer than-normal commentary, keep in mind that, on the advice of my attorney, I have not been able to write about my case until now— and there is a lot of information I want the readers of this paper to know.
But you will not read any whining here. Also, you will not read here that I think that Judge Wayne Miller was unfair— because he wasn’t. Also, you will not read any criticism of the jury. While I do not agree with the verdict, the members of that jury seemed to be paying close attention to the arguments of my attorney, as well as the arguments of the prosecutor. These jurors dedicated four days of their lives to this trial. And I thank them for their service.
